1. Introductory Provisions

1.1. Introduction and Identification of the Seller
These terms and conditions (hereinafter referred to as "Terms and Conditions") of the online store On-Trigger, operated by Ondřej Bílek, with the registered office at Dobrovodská 120/18, 37005 České Budějovice, ID number: 03551628 (hereinafter referred to as "Seller"), regulate the rights and obligations between the Seller and the Buyer when entering into a purchase agreement through the online store.

The online store is operated on the website www.on-trigger.com (hereinafter referred to as "Website") and through the store's web interface (hereinafter referred to as "Web Interface").

1.2. Persons Authorized to Purchase
These Terms and Conditions apply exclusively to consumers, meaning natural persons purchasing goods outside the scope of their business activities.

1.3. Possibility of Deviations
Deviating provisions from these Terms and Conditions may be agreed upon in the purchase agreement. These deviating provisions take precedence over the Terms and Conditions.

1.4. Language of the Contract
The Terms and Conditions are drafted in Czech. The purchase agreement may be concluded in Czech or in another language if the Seller allows it.

2. User Account

2.1. Registration and User Account
The Buyer may place an order after registering on the Website, gaining access to their user account. If the Web Interface allows it, the Buyer can also order goods without registration.

2.2. Correctness of Data
The Buyer is obliged to provide correct and truthful information when registering. If there are any changes in the information, the Buyer must update it.

2.3. Responsibility for Security
The Buyer is responsible for protecting their login credentials and is not authorized to allow third parties to access their account.

2.4. Account Termination
The Seller has the right to cancel the user account if the Terms and Conditions are violated or in case of inactivity.

3. Conclusion of the Purchase Agreement

3.1. Presentation of Goods
All presentations of goods on the Web Interface are informative in nature, and the Seller is not obligated to conclude a purchase agreement based on the offer.

3.2. Prices and Costs
The prices of goods listed on the Web Interface are inclusive of VAT and all associated fees. For orders outside the EU, prices may be adjusted to include customs duties and VAT.

3.3. Terms for Foreign Orders
If goods are ordered from outside the EU, additional shipping and customs charges may apply. The Buyer is responsible for determining these charges and obligations in their country.

3.4. Order Process
The Buyer fills out the order form, which includes information about the goods, the payment method, and the shipping costs. The order is completed by clicking the "Complete Order" button.

3.5. Order Confirmation
After sending the order, the Seller confirms the receipt of the order via email to the Buyer's provided email address.

3.6. Additional Order Confirmation
The Seller may require additional confirmation of the order depending on its nature.

4. Price of Goods and Payment Conditions

4.1. Payment Methods
The purchase price may be paid by the following methods: bank transfer, PayPal, credit card, or cash on delivery (if available).

4.2. Customs Fees and VAT for Foreign Orders
For orders outside the EU, the price may be adjusted to include customs duties and VAT, which the Buyer must pay according to the applicable laws in the destination country.

4.3. Due Date and Deposit
If payment is made in advance, the due date for the purchase price is within 5 days from the conclusion of the contract. The Seller may request full payment before dispatching the goods if required by the order.

5. Withdrawal from the Purchase Agreement

5.1. Consumer Rights
The Buyer has the right to withdraw from the contract within 14 days of receiving the goods, unless exceptions are specified in § 1837 of the Civil Code (e.g., customized goods, perishable goods, etc.). In case of withdrawal from the contract, the Buyer must return the goods at their own cost, for example, by post. The Seller will refund the full amount paid for the goods, including the original shipping costs (if shipping was paid). The Buyer is responsible for the costs of returning the goods.

5.2. Withdrawal from the Contract
If the Buyer wishes to withdraw from the contract, they must contact the Seller via email at ontrigger@email.cz and provide the invoice number related to the order. The Buyer may also use the withdrawal form, which is available below in these Terms and Conditions. After receiving the email, the Seller will inform the Buyer of the next steps and handle the complaint.

6. Shipping and Delivery of Goods

6.1. Delivery Time
Goods are usually delivered within 10 business days. For orders outside the EU, the delivery time may be extended due to customs procedures.

6.2. Shipping Costs
The shipping price for foreign orders outside the EU may vary and will be provided to the Buyer before completing the order.

6.3. Failure to Meet Delivery Deadlines
If the Seller cannot meet the delivery deadline, they will inform the Buyer and agree on the next steps.

7. Rights from Defective Performance

7.1. Complaints
The Buyer has the right to make a complaint about the goods within 24 months of receiving them. For foreign orders, the same periods apply, but the Buyer is responsible for the return shipping costs.

7.2. Repair or Replacement of Goods
In the case of a valid complaint, the Seller will offer a repair or replacement of the goods.

8. Protection of Personal Data

8.1. Processing of Personal Data
The Seller processes the personal data of Buyers in accordance with applicable laws. Details are provided in the Privacy Policy available on the Website.

9. Final Provisions

9.1. Legal Order and Applicable Law
The Terms and Conditions and the purchase agreement are governed by the laws of the Czech Republic. In the case of foreign Buyers, the laws of their home country may apply.

9.2. Validity of Terms and Conditions
If any provision of the Terms and Conditions is found to be invalid, the remaining provisions shall remain valid.

9.3. Changes to the Terms and Conditions
The Seller reserves the right to modify the Terms and Conditions at any time. Changes will become effective after their publication on the Website.

10. Sending Commercial Communications and Storing Cookies

10.1. Commercial Communications
The Buyer agrees to receive commercial communications and information about products to their email address.

10.2. Cookies
The Buyer agrees to the storage of cookies on their device to improve the user experience and functionality of the online store.

11. Sending Commercial Communications and Storing Cookies

11.1. Consent to Receive Commercial Communications
The Buyer agrees that the Seller may send commercial communications related to goods, services, or the business of the Seller to the Buyer's email address, if the Buyer explicitly agrees to this method of communication.

11.2. Protection of Personal Data in Accordance with GDPR
The Seller complies with its information obligations under Article 13 of Regulation (EU) 2016/679 (GDPR) regarding the processing of personal data for the purpose of sending commercial communications, through a special document available on the Website.

11.3. Storing Cookies
The Buyer agrees to the storage of cookies on their device. Cookies are small files that ensure the proper functioning of the web interface and improve the user experience. The Buyer may revoke consent to the use of cookies at any time through the settings of their internet browser.

12. Delivery

12.1. Delivery via Email
Unless otherwise agreed, all communication between the Seller and the Buyer, including the sending of commercial communications, will be conducted electronically to the Buyer's email address.

12.2. Delivery of Goods to Foreign Countries
If goods are delivered abroad, specific conditions for delivery, including timeframes and additional fees, may be set. All costs related to delivery and possible customs procedures shall be borne by the Buyer.

13. Final Provisions

13.1. Choice of Law and Jurisdiction
If the relationship established by the purchase agreement has an international (foreign) element, the parties agree that the relationship is governed by Czech law, even if the Buyer is not a citizen of the Czech Republic.

13.2. Consumer Protection
The choice of Czech law under Article 13.1 of these Terms and Conditions does not deprive the consumer of the protection provided by mandatory legal provisions in the country of their residence. This protection is ensured under Regulation (EC) No. 593/2008 (Rome I).

13.3. Invalidity of Certain Provisions
If any provision of the Terms and Conditions is found to be invalid or ineffective, it will be replaced with a provision that most closely aligns with the original intention of the parties. The invalidity of one provision does not affect the validity of the other provisions.

13.4. Archiving of the Agreement
The purchase agreement, including the Terms and Conditions, is archived by the Seller in electronic form and is not publicly accessible. The Buyer has the right to access these Terms in electronic form if they need to review them again.

13.5. Annexes to the Terms and Conditions
An annex to these Terms and Conditions is a sample withdrawal form. This form is available for download in three different formats on the Website.

13.6. Changes to the Terms and Conditions
The Seller reserves the right to change or modify these Terms and Conditions at any time. Any changes will be effective immediately upon publication on the Seller's Website and will apply only to orders made after this date.
